Please read these Terms and Conditions carefully before entering the Texas Chicken New Zealand’s Luxurious Samoa Getaway for Two. By participating in the Texas Chicken New Zealand Win a Holiday Competition (“Competition”) you are deemed to have read and accepted these Terms and Conditions:

Good Taste  Co Pty Limited trading as Texas Chicken New Zealand is the Promoter of this Competition.

This prize is subject to the Terms and Conditions imposed by the prize giver and prize suppliers.

To enter the Competition, you must be:

•    A New Zealand resident who resides in New Zealand and aged 18 years or over as at the time of entry; and

•    Not be an employee of Texas Chicken New Zealand or participating sponsors.

We reserve the right to exclude anyone from participating in the Competition on reasonable grounds.

Competition Entry Criteria

Competition opens at 10^th December 2018 and closes at 12pm 28^th  February  2019 ("the Entry Period").

To enter the Competition, you must, during the Entry Period, undertake the following steps

 

1.    Complete all of the required data entry fields on the online entry form found at www.texaschicken.co.nz/win , including your full name, email address, mobile number, receipt number, what restaurant they visited of Texas Chicken New Zealand  during the Entry Period.

2.    Only one entry to the prize draw per person is allowed and only one prize will be awarded.

You must not submit any Entry that:

•    Is unlawful or fraudulent

•    Has been submitted or used in this competition previously

By entering, Entrants grant the Texas Chicken New Zealand exclusive permission to use their names, character, photographs, videos, and other information provided as part of the Entry in connection with the Competition and for future promotional and marketing purposes and waive any claims to any royalty, right or remuneration for such use.

Texas Chicken reserves the right to seek verification of eligibility to enter and receive a prize under these Terms and Conditions. Texas Chicken reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's sole and unfettered discretion.

Only one entry to the prize draw per person is allowed and only one prize will be awarded.

Selection Criteria

Texas Chicken New Zealand will select a winner at random in a fair manner.

The winner will be chosen within ten (10) working days of the competition closing.

The winner will be notified via the email address or phone provided on the winner’s entry form within ten (10) working days of the competition closing.

The Winner will have five (5) working days to claim the prize by sending an email to Texas Chicken New Zealand. The original drawn winner will forfeit the prize if they do not claim the prize within the designated time period, breach the competition terms and condition or do not satisfy the entry criteria

Prize

There will be one (1) winner selected at random from all entries received during the Entry Period.

The winner will receive:

•    Two (2) x return economy airfares flying from Auckland to Samoa; choice of airline from Texas Chicken

•    Five (5) nights accommodation at Taumeasina Island Resort, Samoa for two (2) people ONLY in an Oceanview Hotel Room;

•    Airport transfers in Samoa to Taumeasina Island Resort only

All of the above is Subject to availability of Accommodation and flights, block-out dates are as follows:

The accommodation prize cannot be used on these dates: 22nd December -5th January 2019, April 2019 and July 2019.

Winners must purchase comprehensive travel insurance for all travellers. If no travel insurance is provided, then the prize will not be able to be redeemed.

The prize does not include:

•    Passport Visa;

•    Local Taxes;

•    Travel Insurance;

•    Any food or beverages;

•    New Zealand airport transfers;

General

All amounts quoted are in New Zealand Dollars.

Incomplete, indecipherable, or illegible Entries will be deemed invalid and disqualified

Texas Chicken New Zealand reserves the right to check the authenticity of any entry and to refuse to award any prize to any entrant who has not complied with these terms and conditions or has been fraudulent in their entry or has gained an unfair advantage and to forfeit any prize awarded to any Winner if they do not comply with these terms and conditions.

Texas Chicken New Zealand reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or does not meet the entry criteria. Failure by Texas Chicken New Zealand to enforce any of its rights at any stage does not constitute a waiver of those rights.

Texas Chicken New Zealand reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this Competition.

Texas Chicken New Zealand takes no responsibility for non-receipt of any entry for any reason. Texas Chicken New Zealand has no control over the internet, networks or lines including any computer viruses or bugs and server problems, and accepts no responsibility for problems associated with them whatsoever.

If you win the Completion the following applies:

•    The winner must supply photo identification (e.g. a passport or drivers licence) in order to claim the prize.

•    If the winning Entry is deemed not to comply with the conditions of entry, the Entry will be discarded.

•    The winner agrees that they will be available for any promotional activities as required by Texas Chicken New Zealand.

•    The winner must travel together with their companion.  The prize is strictly limited to the flights and accommodation as described above.  The Winner will be responsible for all expenses, including by not limited to, spending money, drinks, transport, laundry charges, activities, incidentals, taxes (excluding departure and any other flight associated taxes included within the Prize) gratuities, service charges, passports, visas, travel insurance and all other incidental costs associated with redeeming the Prize.  It is strongly recommended that the winner purchase travel insurance.

•    The prize is not transferable to any other person and is not redeemable for cash and no compensation will be paid if the winner is unable for any reason to use the prize.

•    The Winner takes the Prize entirely at their own risk and indemnifies the Promoter in respect of any claim for any accident, injury, property damage, or loss of life that may occur in connection with the Prize and in respect of any claims, expenses, losses, damages and legal costs suffered or incurred by Texas Chicken New Zealand as a result of any breach of these Terms and Conditions.  Texas Chicken New Zealand makes no representations as to the safety, conditions and other issues that may exist at the destination.

•    If any act, omission, event or circumstance occurs which is beyond the reasonable control of Texas Chicken New Zealand and which prevents Texas Chicken New Zealand / Taumeasina Island Resort, Samoa from complying with these terms and conditions, Texas Chicken New Zealand will not be liable for any failure to perform or delay in performing its obligations.

•    Except for any liability that cannot be excluded by law, the Texas Chicken New Zealand (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under Texas Chicken New Zealand's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Texas Chicken New Zealand) due to any reason; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a claimant or entrant; or (f) use of a Prize.

 

Privacy statement

All entries will be the property of the Texas Chicken New Zealand. The information Entrants provide will be used by Texas Chicken New Zealand for the purpose of conducting this Competition. Texas Chicken New Zealand may disclose entrants’ personal information to its contractors and agents to assist in conducting this Competition or communicating with Entrants and otherwise for the purposes outlined in these terms and conditions. The Entrant consents to the storage of their personal information by Texas Chicken New Zealand and Texas Chicken New Zealand may use this information for future promotional and marketing purposes regarding Texas Chicken products. Texas Chicken New Zealand may also share this information with the associated sponsors (Taumeasina Island Resort) for marketing purposes. There are certain rights of access and correction of personal information under the Privacy Act 1993.

 

PERSONAL INFORMATION

 

17. By entering a Promotion, entrants agree to the use of their names, photographs and likeness for promotional/advertising purposes, and agree to make themselves reasonably available for this purpose. Any copyright associated with an entry will be owned by Texas Chicken New Zealand.

 

18. Texas Chicken New Zealand collects and holds personal information provided by entrants for the purposes of administering Promotions and for future Texas Chicken New Zealand promotional purposes. All personal information provided by entrants will be held by Texas Chicken New Zealand and will not be provided to third parties unless otherwise specifically set out. Under the Privacy Act 1993, entrants have the right to access and correct their personal information.
